DMCA Policy
Beer Brats is committed to respecting the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Beer Brats will respond expeditiously to claims of copyright infringement committed using the Beer Brats service if such claims are reported to our Designated Copyright Agent identified below.
Filing a DMCA Notice of Infringement
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Beer Brats website or services by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Beer Brats will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Beer Brats service.
A DMCA Notice of Alleged Infringement must contain all of the following information:
- Identification of the copyrighted work: A clear identification of the copyrighted work you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: A clear identification of the material you claim is infringing the copyrighted work and information reasonably sufficient to permit Beer Brats to locate the material on our services (e.g., URL of the specific content).
- Your contact information: Your name, mailing address, telephone number, and email address.
- A statement of good faith belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information is accurate: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Counter-Notification Procedures
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our Designated Copyright Agent:
- Identification of the removed material: Identification of the content that has been removed or to which access has been disabled and the location (e.g., URL) at which the content appeared before it was removed or disabled.
- A statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material in question.
- Your name, address, and telephone number.
- A statement consenting to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the U.S., for any judicial district in which Beer Brats may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
- Your physical or electronic signature.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content or activity is infringing, or that content or activity was removed or disabled by mistake or misidentification, may be subject to liability.
